These Terms of Service (“Terms”) govern your access to and use of the Dossier mobile application and platform services (the “App”, “we”, “our”, or “us”). By using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the App.
Dossier operates as a privacy-focused platform that enables individuals to record, analyze, and optionally connect over personal experiences.
These Terms are governed by the laws of New South Wales, Australia. You may also have additional rights under the laws of your local jurisdiction.
1. Eligibility and General Use
- You must be at least 18 years old to use Dossier.
- You agree to use Dossier solely for lawful, personal, and non-commercial purposes.
- You are responsible for securing your device and all activity conducted via the App.
Part 1: Offline Features
2.1 Purpose
Dossier allows you to privately track personal, health, and intimate experiences via locally stored data. This includes notes, photos, logs, health data, and personal reflections.
2.2 Local Storage
- Offline content is stored only on your device and not accessible by us.
- We never collect your offline entries; exporting or sharing them is entirely your choice.
- You are solely responsible for backing up and protecting your offline content.
2.3 User Responsibility
- You must not store or create content that is illegal, abusive, non-consensual, or harmful.
- You must not use the platform to harass, impersonate, exploit, or defame others.
- You must not violate any local, state, national, or international laws.
- You must not use the platform in any way that could harm, disable, or impair its operation or interfere with other users.
2.4 Intellectual Property
- All intellectual property rights in the Dossier App (including its name, logo, software, and design) are owned by Aionian Pty Ltd.
- You may not copy, distribute, modify, reverse engineer, or reuse any part of the App without written consent.
Part 2: Data Ownership & Privacy
3.1 Overview of Platform Services
Dossier is a local-first journaling experience. The app focuses on helping you record, organize, and reflect on your personal life using tools that operate entirely on your device. There are no built-in messaging or chat features, and nothing is sent to Dossier unless you explicitly opt into diagnostics or email communications.
3.2 Consent and Safety
- All entries must remain lawful, respectful, and consensual.
- You are prohibited from creating, storing, or distributing any illegal or exploitative material using the App.
- We reserve the right to suspend or terminate access where we suspect harmful, abusive, or illegal use.
3.3 Privacy and Content Handling
- Offline entries stay on your device and are not accessible to us.
- We do not pre-screen, monitor, or retain your personal content.
- Optional diagnostics are minimized and can be disabled at any time.
3.4 Access Control
Dossier does not require traditional accounts. Authentication, if enabled, is handled locally (e.g. device PIN, biometrics). You are responsible for managing access to your device and App data.
3.5 User-Generated Content Disclaimer
We do not endorse or assume responsibility for user-generated content. You are solely responsible for what you create inside the App and for ensuring it complies with applicable laws.
4. User Content and Ownership
1. Ownership of Content
You retain full ownership of all data, materials, text, images, audio, video, media, and other content you create, upload, or store using the Dossier application (“User Content”). Dossier and its operator, Aionian Pty Ltd, do not claim any ownership rights, license rights, or usage rights in or to your User Content. You are solely responsible for your own User Content and for ensuring that such content complies with all applicable laws and regulations.
2. Offline Data Storage
Dossier is designed to operate primarily as a local, privacy-first application. Unless explicitly stated otherwise:
- All personal entries, photos, notes, or other data created within the app are stored exclusively on your device and are not transmitted to or backed up on any Dossier servers.
- Dossier has no access, visibility, or technical means to view, retrieve, or reproduce your local data.
- You are solely responsible for maintaining appropriate backups or exports of your User Content. Dossier does not provide cloud backup, synchronization, or recovery for offline data unless expressly stated within a feature description.
3. Responsibility for User Content
You are solely responsible for all User Content you create, share, or store using Dossier. You acknowledge and agree that:
- Dossier has no obligation to monitor or moderate User Content.
- Dossier is not liable for any actions, damages, or losses resulting from your use of the app or from any content you store within it.
- You agree to indemnify and hold harmless Dossier and Aionian Pty Ltd, and their respective officers, directors, employees, and affiliates, from any claims, losses, liabilities, or expenses arising out of or relating to your User Content or use of the App.
4. No Access, Control, or Liability
Dossier does not and cannot access, review, or restore User Content stored on a user’s device. You acknowledge that:
- Dossier cannot retrieve or recover deleted or lost data.
- Dossier does not assume any responsibility for the interception, misuse, or unauthorized distribution of User Content by third parties.
- By using the app, you accept that all data you create or store through Dossier is done so at your own risk, and you understand that Dossier’s role is limited strictly to providing the platform infrastructure to facilitate secure local storage.
5. Survival and Applicability
This clause shall survive the termination, suspension, or discontinuation of your use of the Dossier application and shall continue to apply to any User Content created or stored during your use of the app. This section is intended to remain enforceable and binding under the laws of Australia and any other applicable jurisdiction.
5. Subscriptions and Billing
1. Overview
Dossier offers optional auto-renewing subscription plans (“Subscriptions”) that unlock premium features and enhanced functionality. By purchasing or activating a Subscription, you authorize Dossier (Aionian Pty Ltd) and the applicable platform provider (Apple or Google) to charge the designated account for recurring payments in accordance with these Terms.
2. Payment Processing
All payments, billing, and renewals are handled securely through the platform on which you purchased your Subscription:
- Apple iOS Users (App Store): Payments and renewals are processed by Apple via your Apple ID account. Dossier does not store or have access to your payment details.
- Android Users (Google Play): Payments and renewals are processed by Google via your Google Play account. Dossier does not store or have access to your payment details.
3. Auto-Renewal and Renewal Terms
- Your Subscription will automatically renew at the end of each billing cycle (e.g., monthly or yearly) unless you cancel at least 24 hours before the renewal date.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
- Promotional pricing or discounts may not apply to renewals.
- The subscription period, pricing, and included features are clearly displayed within the app prior to purchase.
4. Cancellation and Management
You may manage or cancel your Subscription at any time:
- Apple iOS: Through your Apple ID account settings on your device or at appleid.apple.com.
- Android: Through your Google Play account settings on your device or at play.google.com.
Cancellations take effect at the end of the current billing period. You will continue to have access to premium features until your subscription expires.
5. Refunds
Refunds for Subscriptions are governed by the policies of the platform provider.
- Apple iOS users: request refunds directly from Apple at reportaproblem.apple.com.
- Google Play users: request refunds through Google Play’s support at support.google.com/googleplay.
Dossier is not able to issue or manage refunds for purchases made through Apple or Google systems.
6. Changes to Pricing or Features
We may update subscription pricing, features, or tiers periodically. Any change will be communicated through the app or the respective app store. Price changes for existing subscribers will comply with Apple and Google’s notice requirements and will not take effect without your consent or the opportunity to cancel before renewal.
7. Account Responsibility
You are responsible for maintaining access to your platform account and payment method. If your payment method fails or your account becomes delinquent, access to premium features may be suspended until the issue is resolved.
8. Termination
We reserve the right to suspend or terminate your Subscription or account in cases of fraud, abuse, or violation of these Terms. Termination will not affect your obligations for charges already incurred.
9. Governing Law and Disputes
All Subscriptions are governed by the laws applicable in New South Wales, Australia, without regard to conflict-of-law principles. Platform-specific dispute resolution terms of Apple or Google may also apply. You agree that any disputes arising from Subscriptions will be handled according to those governing frameworks.
6. Suspension and Termination
We may suspend or terminate your access if:
- You violate these Terms.
- You engage in harmful, fraudulent, or illegal behavior.
- We are required to do so by legal or regulatory authorities.
You may stop using the App at any time. Content stored on your device remains until you manually delete it. If you have used optional sync/backup features, you may need to delete this content separately.
7. Legal Rights and Limitations
Nothing in these Terms excludes or limits your rights under the Australian Consumer Law.
To the extent permitted by law:
- We are not liable for any indirect, incidental, special, or consequential loss or damage.
- Our total liability to you will not exceed the amount (if any) you paid for premium features within the last 12 months.
8. Indemnification
You agree to indemnify and hold harmless Aionian Pty Ltd, its directors, officers, affiliates, and contractors from any claim, loss, liability, or expense (including legal fees) arising from your:
- Breach of these Terms,
- Misuse of the App,
- Violation of applicable law, or
- Infringement on the rights of any third party.
9. Dispute Resolution and Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of that State.
You may also have rights to bring claims in the country where you reside.
10. Changes to These Terms
We may update these Terms occasionally. You will be notified of material changes via the App or our website. Your continued use after any changes means you accept the revised Terms.
11. Export Controls & Age Compliance
- You represent that you are not subject to international sanctions or export restrictions that would prohibit use of the App.
- You agree not to use the App for any purpose prohibited by applicable export laws.
- You confirm that you are over the age of 18 and will not knowingly allow access to minors.
12. Platform Terms – Apple & Google
If you downloaded Dossier via the Apple App Store or Google Play Store:
- Your use of the App is also subject to the applicable store’s terms and policies.
- Apple and Google are not responsible for support or claims related to Dossier.
- You are granted a non-transferable license to use the App on a device you own or control, in accordance with these Terms and applicable store terms.
